Nedlac and E-tolling

The Congress of SA Trade Unions (Cosatu) lodged a section 77 application with the National Economic Development and Labour Council (NEDLAC) last year relating to the e-tolling issue.

The NEDLAC section 77 committee considered the Cosatu notice and despite extensive discussions, the matter could not be resolved as the various parties – government, labour, civil society and business — were unable to reach consensus.

Section 77 of the Labour Relations Act deals with socio-economic protest action. This section of the Act gives employees the right to embark on protected protest action – they cannot be dismissed provided an application has been made to NEDLAC by a registered trade union or federation and that the matter has been considered by NEDLAC.

Much has happened since the section 77 application was lodged, including a series of court actions by interested parties.

NEDLAC remains committed to playing its role, at the appropriate time, in a way which identifies common ground and develops a mutually-acceptable solution.
